NEWS FROM THE MOVEMENT
Black Warrior Riverkeeper(Alabama, U.S.) is celebrating an exciting discovery in their watershed! Thanks to Bernie Kuhajda, a biologist on the organization’s Advisory Council, two new fish species have been identified. The Sipsey Darter was discovered in the Sipsey Fork of the Black Warrior River in Winston County, and the Locust Fork Darter was found in the Upper Locust Fork in Blount County. Charles Scribner, Executive Director of Black Warrior Riverkeeper, views the discovery as a promising sign of ecological health and a win for public well-being. Congrats to the team on this amazing find!
Chattahoochee Riverkeeper(Alabama, U.S.) has joined a state lawsuit against Phenix City for violations of the U.S. Clean Water Act and Alabama Water Pollution Control Act. In July 2024, Chattahoochee Riverkeeper warned Phenix City to stop discharging illegal pollution into the Chattahoochee River within 60 days, or face legal action. On the 59th day, the Alabama Department of Environmental Management filed a state lawsuit, and Chattahoochee Riverkeeper was granted permission to intervene. The Phenix City wastewater treatment plant is permitted to discharge up to six million gallons of treated wastewater daily, but Chattahoochee Riverkeeper has reported foamy discharges, strong odors, and sanitary items, causing spikes in bacteria levels that exceed U.S. EPA guidelines. Chattahoochee Riverkeeper aims to ensure Phenix City and other facilities upgrade infrastructure to protect water quality.
Lower Susquehanna Riverkeeper(Pennsylvania, U.S.) has filed a petition for review in the United States Court of Appeals for the Third Circuit regarding York Energy Storage, LLC's permit to construct a pumped storage facility at Cuffs Run in York County. The Federal Energy Regulatory Commission (FERC) has not yet made a decision on this matter. Although the preliminary permit was approved, it does not comply with Pennsylvania law and exceeds FERC's jurisdiction. As a result, the petition was assumed to be denied due to the lack of timely action. This large-scale pumped storage hydropower facility along the Susquehanna River would create a 600-acre reservoir on approximately 1,000 acres of private property, which includes forested land, farmland, and private residences. If the permit is granted, York Energy Storage will be authorized to take private property without consent, which could destroy the area's ecological, cultural, and recreational resources.
Lower Susquehanna Riverkeeper Association(Pennsylvania, U.S.) has filed a lawsuit against Republic Services for 419 violations of the U.S. Clean Water Act, after the company discharged toxic chemicals into the Susquehanna River. A federal judge ruled Republic Services remains liable, rejecting their claim that the discharges were due to water treatment facility construction. In 2017, the state allowed the company to discharge up to 500,000 gallons of leachate annually into Kreutz Creek, with limits on boron and osmotic pressure. Despite agreeing to upgrade the treatment plant by April 2023, Republic Services continued to exceed the limits, resulting in the additional violations. A follow-up hearing is set for May 21 to determine penalties.
Russian Riverkeeper and California Coastkeeper Alliance(California, U.S.) are urging residents of Sonoma County to join their lawsuit against an ordinance passed in 2023, arguing that it violates the Public Trust Doctrine and the California Environmental Quality Act. The Sonoma County Court has ordered the county to revise the ordinance to align with the existing realities. However, the county has chosen to fight this legal battle rather than comply with state law. It is vital that water management policies are based on factual information and can adapt to both demand and the impacts of climate change, especially given the current scarcity of water. Russian Riverkeeper and California Coastkeeper are calling on residents and community members to urge the Sonoma County Board of Supervisors to resolve this dispute and develop a policy ensuring the long-term health of local water resources.
Spokane Riverkeeper(Washington, U.S.) filed a lawsuit against Purina Mills, alleging that the company has not complied with the U.S. Clean Water Act's requirement to test and report the contents of its stormwater runoff. The Clean Water Act mandates that industrial sites test and disclose the pollutants in their water runoff to prevent harmful substances from entering the environment. This lawsuit aims to compel Purina Mills to take measures to prevent polluted stormwater runoff from contaminating the river, as exposure to these pollutants can potentially harm wildlife and affect the communities that rely on the water. So far, Purina Mills has not commented on the lawsuit.
Buringana Riverkeeper, Surma River Waterkeeper and Khowai River Waterkeeper(Bangladesh) conducted an on-site visit to observe illegal sand extraction and river erosion along the Kushiyara River. Illicit sand mining poses a severe erosion risk, instilling fear in residents worried about losing their homes. The community believes there is a lack of transparency regarding the effects of sand extraction, and they feel intimidated by threats and lawsuits from influential political figures.
Waterkeepers Iraq(Iraq) recently conducted a swimming and diving training session in collaboration with the Experience Wilderness Club. Participants learned essential safety techniques for water sports in preparation for an upcoming festival. This project, supported by the Swedish International Development Association and the Norwegian People's Aid, aimed to improve and teach basic water skills. This exciting training is part of the "Empowering Kurdistan for Waterway Conservation and Environmental Advocacy" initiative, which seeks to raise awareness about the importance of protecting waterways in Sulaimany and the surrounding areas.
SHELF RESOURCES REMINDER
To support an effective opposition strategy against attacks on clean water, environmental protections, and policies, Waterkeeper Alliance has created a repository of tools and resources for Waterkeeper groups. This repository, available here, will be regularly updated based on policy developments, priorities, challenges, and opportunities in the U.S. and globally as information is shared and/or becomes available. To ensure we are meeting the needs of all Waterkeeper groups and strengthening a united global response to clean water attacks, we encourage you to share feedback with Bart Mihailovich, Waterkeeper Membership Services Director, to inform timely and tailored support for your advocacy efforts.
